It is curious that the xyz organization has not offered an opinion on the validity of remote notarization. I would think that if they advocate this process, that they recommend a new form of acknowledgment suited to the remote notarization process. Without personal appearance being made, there is no acknowledgment. It is a requisite part of the notarial act and can't be diminished. I would think that they would have to add a clause such as "appeared before me by means of telecommunication" or some phrase describing how the acknowledgment was given to the notary public. The plan is to limit the appearance of the signer and the notarial act should correctly describe it. This is also a cost cutting method to eliminate the expense of hiring third party closing agents. If it succeeds, I would be interested in seeing if they not only cut the cost to the title company, but also the expenses of the signer's closing costs |
