This Old World English is mind-boggling. . . Say some, ["In witness whereof" does not have anything to do with witnesses to the signatures. It means "as evidence of which", or "to demonstrate their agreement."]
While others contest that the phrase is used to identify someone who witnesses the execution of the document, But is not a party to the agreement (Google Law Dictionary to get more Confused).
