The fact that this is a GA property is only relevant in respect to the fact that all GA property transactions are supposed to be handled by a GA attorney. I did not speak to the attorney in this case, I can only assume that the sellers spoke to the law firm earlier in the afternoon/evening prior to my arrival. It was the sellers who hired me.
The update that LindaH posted was interesting as it appears there was a revision to the GA laws in 2012 making it a requirement that an attorney be physically present, not just on the phone.
Based on that information, I don't know if I will assist in a document signing for GA property again.
Bottom line, if I am hired as a notary, I will notarize the signatures on whatever docs you ask me to notarize as long as there is a notarial certificate or the signer chooses a certificate to be used. |
