Incomplete Limited Power of Atty
Posted by Catherine Ostrom of CA on 7/27/15 2:19pm Msg #535220
Has anyone come across this lately? There was one in a signing last week. It starts off with "I do hereby appoint...". There is no name following. The borrowers didn't want to sign. Upon calling loan broker and escrow, they were told to fill in the name of the lender. Apparently lender not happy with that. They want it left blank and told borrowers that if they did not sign it, they couldn't get their loan. They say if they sell the loan, it would have a different name. It's involving potential foreclosure. I told the broker that I cannot legally notarize an incomplete document in the State of California. Haven't heard any more about that one.

Tonight I have a signing and upon reviewing the docs, find the same situation. No name filled in. Signing company now checking with lender.

Anyone else come across this?
