| What would you do? I recently received a request to notarize the sworn statement of two people, claiming to have witnessed, weeks earlier, another individual’s signature on a “Last Will and Testament”. Of course, a notary should have been present while the Will was being signed in front of the Witnesses, so their signatures on the sworn statement could be notarized in “real time”. It seems, by not viewing the Will being signed, a potential exists for the Notary to be, inadvertently, swept up in a fraudulent transaction by notarizing such an aforementioned “after the fact” witness statement.
