In Kansas, defamation, libel, slander laws can be used even if the report is true in some case law though success if very rare. That said however, I would like to see the law license in question and see if the appropriate membership bar association has a list of complaints per se. Non-payment of services is a "performance" issue. Take appropriate action to those who do not pay in a timely matter, and then there is no need to make a big splash about it.
Also a cease and desist letter is not usually publicized first, as compared to deceased probate notices, in this example. Notices of a lawsuit or a class-action is publicized, but not before its sent directly to the alleged offending party of the second part. There is no cause of action to those who report the words (third party) of the party of the second part unless there is "collusion" which is extremely difficult to prove. In any event, if there is no result, consult an attorney or write it off. |
