Actually the agency was probably acting as the headhunter and it could have been a direct hire. I was hired that way once (was bought out from the agency). But I think it was savvy on employee's part to go over the agency on this.

They just left blank a space to fill in the name."] That's exactly what the hiring agency had on THEIR form - blanks for notary to fill in, declaring him/herself the AA. I believe the only place where the organization name/title/capacity was mentioned was on the actual I-9 (Certification section).
