aren't properly trained. Regardless, both parties are at fault here, IMO. I don't know that I'd take something as important as a Will to a UPS store for notarization. Also, the notary should have declined to do it if they didn't understand the ramifications.
I notarize Wills & POA's frequently. I do know that VA requires witnesses on those documents, and that the witness signatures need to be notarized. It isn't UPL to understand what is required for the proper notarization of those vital documents.
The problem is that you never know if the Probate court will have an issue with the document until after the fact, when it's too late. |
