I received an email from the singing service 5 days after sending in the documents from a signing that was two hours away. There issue was that I had not notarized the Subordination Agreement. After reviewing the document package I found that there was no request for notarization of the Sub agreement and there was no acknowledgement following the Sub Agreement. I replied that I would be happy to go back out and take care of this for a fee because the lender had forgotten to require the notarization. The SS response was that I should have known to notarize the Sub Agreement even if there was no acknowledgment included and I should go back out for no fee. I talked to the NNA rep and they agreed with me. However, rather than fight this further I did go back to the borrower and have him resign the Sub agreement and I notarized it. What would you seasoned pro's have done in this case? |
