There's another area of confusion that I don't think anyone has mentioned yet. I was looking at the Montana law:

It's theoretically possible to take an acknowledgement of a PAPER document remotely. Imagine Joe lives in MT and is personally known to MT notary Mary, and Joe needs to sign and acknowledge a deed for MT property. Joe has two weeks to get it done, but he is in a foreign country, the local notaries are expensive, and the nearest US Consulate has a wait list of several weeks for a notarization. So Joe signs the paper deed, sends it FedEx it to Mary, gets on Skype, and acknowledges to Mary that he signed the deed.
I believe VA law says that remote notarization can only be done on electronic documents, but I can't see any such requirement for MT. |
