You can be in the same ballpark, you just can't all be on the same base. As long as they're not discussing pricing with their competitors, there's no price-fixing.
When I worked as a Realtor, we were forbidden to discuss our commission structure with the competition. The standard commission was 6% but could go lower, depending on what the listing agent was able to negotiate with the seller. The difference was in how the commission was split, both between listing and selling agent, and between broker and agent. The selling agent only knew what his or her cut would be, not what the full commission was, so there's no price fixing there either. |
