Very Very Bad Company

I did some signing for Enrique Acosta, from TEXAS FINANCIAL CLOSING AGENTS, LLC in Austin, back in December and still payment has not been recieved. At first he would say "I mail the check out already", but never recieved. Then I recieved payment for 3 assignment, and still owe for 18 assignment. Sent invioce and statement, no responds, he has not return my calls. Would any one know what else could be done to collect, this is a good amount due.

with payment receipt for only only 3 signings?
I would have required payment for several signings before continuing.
That's just me.

Ditto what Stephanie said. I will only do 2 signings for a new company; once they pay me for those 2, I'll accept more. I need to know they are credit worthy before giving them a whole lot of credit.

It's the same orincipal as with credit cards...when you are new to the credit card company, they don't give you much of a credit limit. Once you prove yourself to be credit worthy, your limit goes up. It's interesting to note that interest rates are quite high these days...probably because of all the uncredit-worthy people!

You gave this guy way too much credit, and it may be coming back to bite you. Now you know and this will help you to set firm limits and not accept signings for a new company until they prove themselves worthy of the risk.

Googling his name and doing a search here will reveal lots of issues with payment problems. Moneyman expounded on the issue in detail some time back.

Here is a link on how to sue in Small Claims Court in Texas

IMO-not legal advice***, I would send him one demand letter requiring payment in full, informing him you are contacting the lender and title company for each signing to report his business activities, or lack of. You hopefully have (and should) keep a copy of every HUD-1.

I would also inform him that if payment is not received in xx hours, that you will be suing him in small claims court (up to $10,000 in Texas) for the amount owed, any fees and time lost. Inform him further that you will be subpoenaing the lenders and title companies to substantiate that these are valid orders and services were preformed.

If you get no satisfaction then IMO, I would do the above. 18 closing is a good amount of money.

Never do any more than 3 signings for a company until you know how they pay.
I always gave companies a "credit" for three signings. If they called me for a 4th one before I had been paid for the previous 3 then I would be "busy" until I got paid for the 3 already done.

Great advice Sylvia! That's my standard line as well. Much more professional than confronting or whining at a scheduler about payment issues. If I don't receive payment, I contact accounting and take it up with them.

I 1st got involved with him in Dec last year. I accepted a"Property Tax Solutions" assignment from him. We did it in my office. printed 21 pages. Notary on to docs. I accepted it for $50.
Be fore I did this he was trying to "pawn" of regular re-fis on me at the $50 including print and travel. I refussed them unliess he paid my fee of witgh travel of upwards of $200.
I gave him some name closer to the distance signing, only to find out she had turned him down as she wouldn't work for his lowball fees.
I'm sorry he stuck you,
Also, watch out for Bettis who is in Temple/Belton.

When it was in my State, I've had some success with a strong letter outlining action plan that includes a complaint with the Attorney General of the state. I am not sure that office would have done anything but it appeared to have worked. Or maybe I was just lucky. I see he is in your state so and someone gave you direction to go after your money. I have always found that to be an advantage. I hope you get your money. Hindsight is always 20/20. And it's hard to believe it can happen. Business is tough enough without working inadvertently for free. Good luck to you. Hope you get your money.

I took was not paid for signing services. Do not work for this company. Phone calls/emails will not be answered.
