I am having a similar, if not the same, problem w/my Brother MFC8840. The software suite that Brother has will not install on Windows 7 & the drivers they have for Win7 are really lame: one can copy legal, but not scan to a file on legal. Plus a few other things like the fax part of the machine will not fax correctly in Win 7. What is maddening for me is that when I first upgraded to the Win 7 program I was able to install the Brother Pro-Suite of scanning tools even though it says it will not work with Win 7. Some how I got it to install & it worked just fine for 2 years, when the hard drive developed some problems. On my new hard drive I had to go back to Win Vista in order to get the MFC 8840 to function correctly. It is such a great multi-function printer with those drivers but under Win 7 it really sucks. I too would be interested in a solution to this.

Has anyone contacted Brother? I've had issues when I've had to go there. Also, sometimes Microsoft has a solution.
Another option, a 3rd party scanning program may work.
Just some suggestions.

Paperport won't work the paper size legal option isn't there
Brother hasn't helped at all, they said that the fix was with a Windows 7 update, it wasn't. I finally have the printer scanning but it only scans letter size.

Not sure it would work, but might I suggest uninstalling the Brother suite and reinstalling? I used my MFC-8460N Brother suite in W-7 and it worked fine. When I recently upgraded to a new MFC-8480DN (two months ago), I again installed the Brother suite , using W-7, that came with the MFC and it works without any issues as well.

Brother hasn't written a program compatible for Windows 7 for the MFC 8440. Maybe because they have discontinued making the unit. I'm about ready to reinstall windows xp on my computer.

Not sure this will help but it's worth a try.

Not sure you have enough space but you can run multiple OS on the same computer (ie XP & W-7)

I'll give it a shot, thanks for the info. I'll get back to you on how it works out. Right now I'm having to use my laptop (it has vista) to scan the legal docs. But it gets old having to change out the printing cables etc in order to scan legal docs. Would be nice to get everything working on one computer.

What I did with similar situation.
I have an MFC 8220 with Paperport and Windows 7. It too wasn't scanning legal. After several frustrating attempts to have it scan to size, I simply went into Paperport and changed settings to legal. Now, everything scans in legal size. Not the best solution but at least recipient gets the full page instead of cut offs.

I tried that, the option for choosing "legal" isn't there on paperport for the MFC 8440 in Windows 7. It is in Vista but not on Windows 7. Brother provided a compatibility program for Vista and hasn't done one for Windows 7.

I have to do the same on the Brother Control Center dash board. In the configuration tab I have to tab over the scan and file and change between scanning letter size or legal size.
