Am I an independent contractor or employee?( Standards were sent to WA ESD:

State ESD response: All your documents were sent to the audit regions throughout the state. They are in process of reviewing them and what will happen is that it will trigger audits on mortgage companies. We usually don’t audit banks but this may change after we received your documentation. One thing you can do is that when you are working with a certain bank, please send an email with the information on that particular bank like location, bank name etc. This may trigger an audit which will lead to a determination by our agency whether you are an employee or independent contractor. Of course, your tip will remain confidential.

Thanks for getting back to me. If the bank is national (e.g., Bank of America, Wells Fargo, Citi) and the lender does business in WA and the customer is local, would that trigger an audit?


Answer: Most likely yes. However, big banks have only one account and several different locations. It will be hard to audit a big bank like Bank of America since the information may not even be in WA. Just wanted to also let you know that we are the collection side of the house and we don’t conduct audits but we still can forward tips. When the ball gets rolling I will transfer you to one of the audit regions so you can communicate directly with one of the supervisors on that side.

If you don't understand what would be looked for in an audit. Download a form SS-8 from the IRS website and study that.

Also, ask during the audit if you are a statuatory employee. If you don't know what it is, google it and be ready to ask the question.
