question for FL Notaries
I'm doing a closing next week here in KY for a second home in FL. I lived there and if I'm not mistaken FL mortgages have to have 2 witnesses right? But since I'm doing this here in KY do I still need the witnesses ?

Witnesses needed not needed for FL mortgages...
but are necessary for deed conveyances. The notary can be one of the witnesses.
The 2 witnesses are still required for conveyances, even though you're not signing in FL.

Roger is right about FL law - however some counties have
imposed their own witness requirements - around me, Dixie County and Suwannee County both require two witnesses on mortgages - there may be other counties through the state that require them. If I were you I'd have title make the call on this - it's on them if they say no and they need it redone because it won't be accepted for recording. If you can't get anyone at title, you can always have two witnesses sign to play it safe.
Also, for the future - witness requirements on docs to be recorded are governed by where the document is to be recorded, not where it's signed.

I leave it up to borrowers to arrange for an extra
witness. If they absolutely, positively do not have anyone (which happens a lot around here) I offer to provide one with permission of title/hiring party and borrowers, but there's a fee for that.
