Yes, I had a situation where coercion was involved. It does happen.
To check for mental competence, I asked to speak with an elderly signer alone, and asked the others in the room to leave so I could ask basic questions (like Clem’s questions- date, awareness, etc.) unprompted.
At which point, the signer disclosed that she did not want to sign the documents (as it would be giving her home solely to her son, and she had other children to consider). When the son returned to the room, she changed her demeanor, cowered in his presence and started to backtrack. I politely but firmly let them know that I would not be proceeding. The hiring party was a good client and was fully supportive. |
