My state has no specific wording in the law (indeed, it has hardly any law at all). I don't have anything from the state government saying one way or the other.
In states like mine, where no particular wording is required for an acknowledgement, I would look carefully at the wording, to see if it says that the document was signed in the presence of the notary. If the acknowledgement is silent about when the document was signed, I personally would go with the general national understanding that an acknowledgement may be presigned. But if the certificate says it was signed in my presence, then the signer will have to resign. |
