If I lived near Sacramento.....
Posted by Bear900/CA of CA on 6/14/21 11:09am Msg #632721
Here's what I would be doing...

I'd be banging my shoe on the counter asking for clarification on some matters. Having done this a few times with other government agencies, I'm fairly familiar with how things roll. I saved one company I worked for over $50k by asking tough questions to enforcers who in the end backed me up, and not in writing.

Me: May I conduct my business a certain way, based upon what is written in our law, rules or statute?
Them: Based upon their everyday business I presume: No, you must do it this way.
Me: Please tell me how you feel about me going about it another way using what fulfills this particular law, rule or code. (not using my interpretation, rather using what is in writing in my favor. They do the same.)
Them: Look of perplexment, usually followed by a consult with a supervisor. Then...yes, you can do it that way.

I'm not there to challenge the law, rule or code. I'm asking if I can work within it, doing business a certain way.

I did that with the SOS, posted here and got heck because I didn't have it in writing to change what appears to be black and white to others. If it was such, I wouldn't have received the answer that I did. Maybe at best, others could do the same.

Agencies will always tell you what's easy and most common for them to understand. Maybe I take a particular pleasure in taking them out of their comfort zone. But when I do, I make sure I have a means of conducting business that fits within existing law.

If CA notaries are willing to put so much effort into fighting RON, why not so determining what else can be meant by 'sequential journal entering'? i.e. The CA SOS doesn't stipulate, nor should they, the use of lines vs pages to put into sequence entries made. Think about what can be done with an entire page.

What about the requirement to enter a 'time'? I get it, 16 pages are notarized, and a stop-watch is clicked 16 times, for each signer, to get the exact time! But wait, there are 4 signers. Hmm...why do I get the feeling all signature times are lumped together? Any lumpers out there? Shame on you.

You want to talk about locking the journal in a safe, file cabinet or behind a closed door with only you having excusive access, per law? While I agree with this one 100%, how many are doing it? It's in black and white.

I could go on. Just make sure your phone is charged so you don't miss that assignment as you're driving down the 405. "I get 'around' that using Bluetooth." Ohhh...really?
