I've read about a similar situation in which it wasn't obvious. I don't remember the details, but I believe the male organs were still primarily inside the baby's body and there was no obvious distinction between one sex or the other. Clearly an agonizing situation for a parent. A case like this brings challenges regardless of what they decide to do - or not do in the moment - but with some slowly changing attitudes these days, it might be less so than in the past. So I can see where the NJ law, and the approach Hugh described, might make sense. |
