I am NOT an attorney. Ack/jurat certs are NOT the notarial act itself. They are completed by the Notary only AFTER what constitutes the act, which includes but is not limited to:
Signer appears in presence of Notary Signer presents ID, signs journal (if required) Journal is signed, thumbprint given (if required) Doc is reviewed for completeness and blanks Signer communicates willingness to sign of own free will Doc is signed, oath given (jurat)
The above is the notarial act......the cert is filled out, signed and stamped by Notary AFTER the above is done...as PROOF that the above was done. I am not an attorney so consult an attorney. Follow your state’s handbook if they clearly address the issue. If they don’t and your SOS is no help, then consult an attorney for advice. |
