I'd still sue him in small claims. Probably about $50.00 filing fees, another $30.00 to serve him, and of course all the paper's in triplicate sent via certified. Do you really think he will throw money after you for slander when he brought this all on by himself? That's really hard to prove and more money than it's worth, all to make himself look foolish when the truth comes out. Just me.
