I received a request to meet with the oldest of three sons to sign a durable POA. His mother whom he had not seen in over five years drove down from the Bay area and we met in the lobby before proceeding to her room. Mom is 94 and had difficulty getting around. One of her two I sons who live in her home called the EMTs to take her to the hospital. When the EMTs saw the squaller and filth she was living in, they called the Sheriff. The one son who was present was arrested, and later booked for elder (and likely financial abude abuse). The eldest son has done quite well for himself in the high tech biz. The two younger sons both have blemished backgrounds and ongoing investigations for elder abuse and embezzlement of other citizens who were in their care.
We completed the POA and mom is now safe and being nurtured back to health. The two sons can only visit her in the company of an ombudsman She wasn't eating very well and not being kept clean. Such a darling lady. She has lived in her home for over 45 years. She was an educator and a musician. Her home has a reverse mortgage. Her sons have spent all her money and think they are entitled to her home, but of course they have no way to purchase the property now. At Mom's passing the lender can sell her home. One of the sons recorded a grant deed adding him to the title. The RM lender made him and title take him off title, as he is not a spouse.
This is the variety of work I come across in this business. I suspect situations like this will become a lot more common in properties with a lot of equity. OR, if the lender decides to schedule an inspection of the property, things may move along a lot faster, especially given the condition of the property.
I am only a witness that Mom knows what she is signing and and not being coerced to sign. Her oldest son can now act in her best interest. |
