While C.A.R. supports online notarization, C.A.R. and the California Land and Title Association oppose AB 1093 which could retroactively invalidate real estate transactions. The Assembly Judiciary Committee amendments adopted on January 3rd would invalidate, or at least put into question, the long-standing interstate recognition doctrine if a remotely notarized document is executed in another state – potentially invalidating any recording made outside of California. The amendments will create gaps in the title record and opens realtors and their clients to liability based on who notarized the documents completing their transaction. C.A.R. will oppose AB 1093 until our concerns are resolved.
