Re: Question About the New Required Florida ACK and Jurat

View from an outsider:

I believe several states that allow RON require that notarizations done this way state in the certificate that the signer appeared using audio-video technology, or words to that effect. Apparently, Florida has taken the view that it isn't enough to ASSume the person was in the physical presence of the notary unless otherwise stated, every certificate must specify which of the two possible ways to appear occurred, (1) physical presence, or (2) online.

I believe there is one state that has passed a law indicating it is illegal for an out-of-state notary to perform a notarization if the signer is physically in the state that passed the law at the moment of the notarial act. And other recent threads have discussed getting such a law passed in CA in the future. Such laws would be easier to enforce of the certificate indicates whether the notarization was through audio-video appearance or not.

In addition, some document recipients may choose to reject RON, so having the certificate state which method of appearance was used will be helpful to these recipients.
