Because the foregoing link is a long read, the basics of it are: A Kinko-FedEx employee notarized a document without the signer present on a mortgage transaction. A lawsuit was leveled against the employer which and whereupon an appeal was filed. The appellate court reversed the lower court and found the notary totally responsible for a damages and court costs. This occurred way back in 2008. Now we have internet signings without the true presence of signer and notary face to face in the same room. Yes arguments will say that identity documents are shown and perhaps sent over the internet and its just as secure. But is it, is the question.
