If the lender says it's OK to sign prior to that date, that is their decision. Since this is a split signing and the 2nd signer is not signing until 02/03/18, I understand why they would want it this way.

As long as your notarial certificates show the date you actually meet with your signer, why would you even care? They aren't asking you to break any laws.
