From various comments I've seen on this forum, even in this thread, there seems to be some confusion about how to count notarial acts for fee purposes. I don't have fee regulations, so I don't worry about it. Some people seem to think each time a person signs a notarized document, they can charge $10. So lets say there's a mortgage with two signers and one certificate. There's a survey affidavit with two signers and one certificate. There's two signature affidavits, each has one signer and one certificate. So that's a total of 6 signatures, so the fee is up to $60.
Other people seem to think a notarial act is filling out the certificate. (I don't agree with this view.) In the example above, there are 4 certificates so the fee is up to $40.
The new language seems easier to understand. Each time a person signs, it's $10. One person signing 2 documents? $20. Two people signing one document with one certificate? $20.
I can only think of one rare case where the fee would be less. A person signs a document, acknowledges his signature, and also swears the document is true. One signature. One document, $10. But it's two notarial acts and two certificates, so would be $20 under the current law. |
