Recently I notarized such a QCD via POA with a borrower whose husband is in an Alzheimer's residence. It was all part of a refi/cash out for his ongoing care. It was an interesting package vesting held in the name of their trust. She is now empowered to sign for him via POA for any of their properties due to his condition. Title and escrow prepared all these documents for the spouse to sign. Spouse had a letter from physician that husband was not competent to sign legal documents. |
