What strikes me about this blanket language is it ignores the authority of individuals to conduct their own legal affairs, even if it would be smarter to hire a lawyer. If my neighbor wants to sell me that vacant piece of land next to my property, and we want to sit down at my kitchen table, have the notary down the street come sit with us, and do it, should the state be telling us one or both of us MUST hire a lawyer?
Even if the state did do that, and we did the closing without a lawyer anyway, who would be practicing law without authorization? The buyer, the seller, or the notary? |
