Sadly, it was poorly written. As written, it opens the door for ANYONE to conduct sale/purchase closings, including taking in all the money and writing the checks to disburse it. Lenders can still REQUIRE attorneys to represent their interests, and probably would as lenders require title insurance to protect their interests and those insurance policies can only be signed/issued by a Connecticut attorney.
A re-write and re-introduction specific to what parts of a real estate purchase, sale, or refinance can be conducted by a non-attorney. For example, a comfort level would be restricting non-attorneys from setting up their own escrow accounts to handle the money involved. |
