I actually contacted the SoS in MO and also in KS (I am commissioned in both) and asked about handling applications. I was told that if, and only if, all I was doing is making sure the person(s) had signed/did sign and date everywhere needed, that it would "probably" be okay for me to do these. Under no circumstances am I allowed to "help" complete the loan paperwork as that falls under loan origination and I must be licensed for that.
I choose to not get involved in these at all, as I have heard stories where the job was supposed to be just getting signatures and ended up being much more involved, as the forms were not fully completed beforehand. If you do these, make certain that you get in writing that the forms will already be completely filled out. Even then it is a grey area, but you would be far less likely to have it come back to haunt and hurt you. |
