I decided that I needed more clarity on this issue myself, so I did a Google search. Here are some links that may provide more insight than (like I did) repeating what's been told to me by an EO. (She may have given me her interpretation of the reasons behind the CA law.)

Chasing several links got me to this site twice, so it looks like this is the actual code that governs this issue:

This case seemed to be referenced in some of the other links I found. I didn't dig deep enough to find a ruling on it, but it might be of some interest to some of you anyway...
