As Linda said, a durable POA would be good to go … but as Pegi said, title could have/should have prepared one specifically for this transaction. It's been my experience (mostly when one military spouse won't be in the country when a refi is coming up) that a special POA has been prepared just for the upcoming transaction. And only that transaction. For that reason I would not have notarized a QC (of all things!) just cos someone is waving a piece of paper around. Not my job to wade through a POA, figuring out of it's legit, if it covers giving up property, etc. Ridiculous.
Additionally, QCs are often signed ahead of time ….. not during the loan closing. Some lenders have prohibited QC signings at a closing due to possible undue pressure being put on the person quit claiming.
At the very least, title should have alerted notary that the durable POA would be in use and that it had to be returned with the docs for recording. The fact that title did none of these things makes the whole deal highly suspicious. |
