Are these considered "assaults" ... ??

Devices were intercepted. However, intent was there, mechanisms were there, capability was there.

Is it more of an "assault" when great bodily harm and/or property damage is intended and possible? Is it an "assault" if the only possible outcome is public embarrassment? Would the latter instead be reclassified ... maybe "public outcry?"
