I run into this a lot, but the problem lies, we have to notarize the new name on the docs, not the old name, even with the AKA in there. That is to benefit the lender, not us necessarily. I always tell people that are about to get married to save their old DL, marriage license the paper trial so down the road when they do that refi they get that name change correct or have both names on the signature like Jane Doe FKA Jane Smith. If all the docs are in the old Jane Smith and all her legal ID that we can accept is in Jane Doe, there is an issue. The AKA is fine, and she says that is her, but for us, we cannot notarize an old name without a current legal accepted form of ID.
