Actually, unless it's different in other places (and I doubt that's the case on this issue) the docs have to be drawn on the name as it is most recently recorded. HOWEVER, if the vesting is checked early enough in the process, it may be possible to take some corrective action prior to signing loan docs.
As is clear from this thread, different states have different processes for doing so (such as the FKA option available some places). A Deed could be filed to change the vesting before the docs are drawn or the borrower could even get their ID changed in some cases, in advance of the signing. That would save LOTS of headaches!
The most common situation where I've seen this be a problem is when a couple buys a home together before they get married, then the bride changes her name (and eventually her ID) after the wedding, never thinking about the fact that once the prior ID expires, she may no longer be able to provide acceptable ID to prove she's the same person as the one who bought the property. Again, the remedies will vary from state to state.
