When you say "tagging", you mean marking the spots in the document where the image of your signature and the image of your seal will go, correct?
It depends on what state you are in. It also depends on what the patriot form says. If it doesn't have the language for a notarial act, some states forbid you from placing your seal on it. Some states require that your electronic signature that is connected to your digital certificate only be used for notarial acts, so if you are asked to sign the patriot form as a signing agent, not a notary, you would have to use a different digital signature, or perhaps just type your name.
Even in states that are silent about using your seal on a document that isn't notarized, it's generally discouraged.
IF THE PATRIOT FORM DOES HAVE NOTARIAL LANGUAGE, you must determine who is appearing before you, and what notarial act is needed. If the borrowers are appearing before you and taking an oath that the driver licenses they showed you are really theirs, great, go ahead.
If the patriot form has YOU swearing the ID is correct, no can do: you can't administer an oath to yourself. |
