I was on vacation during my last post using one of the last lender emails I received while in Yosemite. I am catching up, including some additional research.
Interpretation of the CFPB TRID rules seem to vary this year including one major source who says in a *conversation* with the CFPB, that Monday June 20, 2022, *may* be included as a rescission day, however a conservative approach not counting it as a rescission day is allowed.
I agree using the lender's and title's instructions is the best route here.
You may recall (ha!) during your TRID Certification there are some loans that do not fall under TRID such as reverse mortgages, HELOCs, and a few others so a refi of one of those will count Monday as a rescission day.
It's interesting that most posters here have loans excluding Monday as a rescission day and that appears to be the approach most lenders and major title companies are taking. Whether this is a conservative approach, or their legal interpretation is unknown, but best go by it.
