Just out of curiosity, what's your MO ... when do you apply your notary signature and stamp on your notarial certificate? During signing immediately after signer and in the presence of signer? Or at the conclusion of the signing after you and signer have parted ways? Or ahead of signer before you even meet him/her?
In 2005, I was taught that as a notary I was to allow signer to sign document in front of me and then I was to immediately affix my notary signature and stamp in the presence of signer. I've always done it this way. I prepare my notarial certificate (whenever possible) ahead of time; but, my signature and stamp are affixed in front of signer at time signer signs that particular document. I've been a notary/signing agent since January 2006.
The SPW Code of Conduct (for XYZ NSA certification) reads: "2.10. Completion of Notarial Acts The Notary Signing Agent will complete the notarial acts on all closing documents and the journal entries for the notarizations in the presence of the signer at the appointment when the documents are signed."
I'm in California and just checked our California Notary Handbook. I didn't see it addressed there (or did I miss it?).
