With the I-9, the feds don't require a notarization, and REQUIRE the employer to accept the kinds of ID listed in the I-9 instructions. Some combinations of ID that are good enough for the feds are not good enough to satisfy the ID requirements of some states (or in states with no spelled-out requirements, what the notary considers sufficient). Examples include a foreign passport with a a temporary I-551 stamp in a state that only accepts foreign passport for real estate related notarizations. Or, a state fishing license with height, weight, and signature, combined with a social security card. If the employer indirectly requires ID that the feds say they are not allowed to require, the employer can be accused of illegal employment discrimination on the basis of national origin. |
