I too received my notice from the United States Bankruptcy Court in Savannah, Georgia, that Terrence J. Todd and Lorrie L. Todd have filed bankruptcy in the Southern District of Georgia United States Bankruptcy Court. Case Number is 17-41358-EJC. They have filed under their personal names and FDBA North Georgia Home Rescue. There is no mention of American Signing Connection on any of the paperwork I received.
I have spent the morning making numerous telephone calls and UPDATED INFORMATION IS AS FOLLOWS:
1. The Bankruptcy clerk's office 912-650-4100 states that it is the largest bankruptcy filing she has ever seen with 274 pages and 619 creditors (notaries). It appears that there is roughly $363,516.00 in what appears to be unpaid notary fees in small amounts of $85, $100, $185, $375, etc. The Todd's get to retain their $170,800 home in Savannah, Georgia and $235,702 in personal property.
2. The Bankruptcy clerk's office is asking not to file a proof of claim at this time as no property appears to be available to pay creditors. If it later appears that assets are available to pay creditors, the clerk will send you another notice telling you that you may file a proof of claim and stating the deadline. (Although they say this, I have seen that other notaries are filing claims and I think that is a great idea.)
3. It is important for each and every notary that is owed money by American Signing Connection to contact The Bankruptcy trustee, Tiffany E. Caron. She can be reached at 912-234-1215. She needs to know that American Signing Connection hired more than 619 notaries over the course of a year knowing full well they were never going to pay them, went into hiding while they sold their house in Cumming, Georgia, and then ran off with the money and are now trying to hide in the bankruptcy courts. They should be facing criminal charges for theft rather than getting to declare bankruptcy for funds they stole from notaries.
4. Any notary that is owed money can file a complaint that the debtor is not entitled to receive a discharge of any debts, or you can file a motion that you assert that the discharge should be denied. The Bankruptcy clerk's office suggested that we contact a creditor attorney to help us with that. I will be contacting my attorney to see if that is something he can help us with. Filing deadline is 12/5/2017.
5. All documents filed in this case can be viewed at www.pacer.gov.
6. Meeting of creditors will be held on October 6, 2017, at 2:00 p.m. Debtors must attend the meeting to be questioned under oath.
I will post more updated information as I receive it. If you have any questions or need help with filing complaints or motions, please do not hesitate to contact me via e mail, or pm. I obviously am not an attorney and cannot give you any legal advise, but I can certainly point you in the right direction. There are approximately 619 of us and we all need to work together in letting the Bankruptcy Courts know what these people have done . . . they have stolen our money . . . and so far they have gotten away with it.
Amanda Kirkish, Frank Amari, Michael Tomlinson, and now Lorrie Todd. This keeps happening . . . signing companies pocketing our money and then running to the bankruptcy courts. It is now time to finally put a stop to this once and for all.
Thank you and good luck to everyone that is owed money by American Signing Connection.
