woman was going in to hospice care and a board and care facility. She was sitting up talking and "withit" on Saturday afternoon. Signed Advanced Health Care Directive, POA, and some other documents naming son, attorney in fact.
Sunday, mid-morning, I get a call from the son and daughter-in-law. They are in a panic....mom passed away Saturday night and the board and care facility lost the POA, etc. What could they do since it was lost so son could take care of arrangements? Nothing.
Doesn't matter that they lost it. The will or in this case the trust kicks in. Who's the executor of the estate? The son. OH! They didn't realize that POA is only valid while the person is living....
