Some court documents must survive indefinitely. But many court documents are transitory, and don't need to survive past the conclusion of the case.
Real estate records are different. I'm planning to build a garage, and needed to know where my road is so I know how far to set the garage back from the road. With a dirt road, the edge keeps moving around with storms and the mood of the grader operator. So I went into the town records to find out when the road was officially laid out. The relevant record was dated 1810.
No one has ever demonstrated an ability to keep a digital record for 200 years, which may be why some jurisdictions are reluctant to embrace digital recording. |
