This was very comprehensive and well done (probably by an attorney), with legal citations, etc. I think I've posted this info before, but it's worth posting again. Rather than us starting from nothing and trying to put together our own arguments against this issue, it would probably be very effective to simply refer to this document with a couple of comments. Even if much of it is directed to CA law, I'd think the principles will apply everywhere.
I don't believe this battle is near over. The supporters are clearly not promoting this practice because it's good legal policy! They've got lots invested in this and are prepared to go the distance, so let's keep spreading the word.
