The problem appears to be that there isn't a 'carve out' for the signing agent/notary in the law. I agree that going about business as normal will probably not raise any problems. However, all it takes is for one signing agent to make a claim under the new law to bring the whole thing into the courts where anything can happen. For those that have an interest and/or connection, it may be time to try and have an amendment made to the law to exempt the signing agent business.
As for contracts, the signing agent should be the one producing the contract, not the signing service. After all, you are an independent business and have the right to write the contract you are willing to work under. Again, those with an interest may want to work on a standardized contract for services, with an amendment for individual pricing schedules. |
