That's not the way it works.
DJT did nothing to reinstate the ban.
SCOTUS dropped part of the lower court injunctions against the existing ban ONLY and granted cert to hear the full case in the October term.
Lower courts can do nothing to block this particular EO at this point.
SCOTUS will hear the case in October IF the administration can prove it's not moot at that point.
If DJT issues another similar EO, then we lather, rinse and repeat - we start all over again. All SCOTUS did was grant cert on THIS CASE - there was no decision and therefore no precedent. |
