It was an executive order, and I agree with you completely. It was only supposed to be temporary, but the GOP has proved to be so inept because of their factions that they couldn't get it fixed. What's surprising is that Trump is now cutting a deal (and not a very good one for him) with the Dems in order to get that done, completely blindsiding the GOP in the process.
Questions were raised in the press conference about why Gop leadership had not been invited to that dinner along with Dem leadership, and Sarah Huckleberry Sanders replied that there was no need for them to be there because Trump is the leader of the party and would represent their interests. Yeah, well, that didn't exactly work out as planned.
Worse for Trump is that the far-right wing of his base is now really upset - he's negotiating with the Dems and ignoring his own party in the process; he campaigned on ending DACA and building the Wall. He just broke the first promise and delayed the second one yet again - although he signed an EO on the first day to start building the Wall, it still hasn't even been designed yet. It will take YEARS of legal battles to get the land required - most of the land on the border here in Texas is private property, and the owners are not too thrilled with the prospect of having some of their land on the Mexican side of the wall.
