Since I did not like the answer to my phone call I decided to email them so I had something in writing. My question to SOS: “ Short Description: aka notarization Your Question or Comment: A couple of month ago a borrower signed with an aka name ex. (Lori L. Smith aka Lori Smith), I acknowledge her name on my certificate as Lori Smith because this was the way her name was printed on all the rest of the docs. Amador county want an acknowledgment with both name on it. Can the notary notarized with an aka name? I was under the impression we cannot notarized capacity. Please advice Gavina Name: : Gavina Franklin ”
The reply to my email “ Dear Gavina Franklin, Thank you for contacting our office regarding the duties of a notary public. California notaries public are not permitted to verify the signer’s capacity (also known as) for a notarial act. Please note, there are no provisions in the California notary laws that allows for the correction of a notarial act. If a correction is needed, a new notarial act is required. Sincerely, Notary Public & Special Filings Section”
When I call the site suggested in the initial phone call, I was told that aka is not capacity.
