I’m not sure if this article goes into the history of Colorado’s Mandatory Sentencing. One of the women who lost her husband briefly mentioned it came about in the 70’s. Actually, it was the 90’s. It was enacted because there was no rhyme or reason when it came to sentencing and it was not a fair process — one Judge may have given Community Service with no time, another may have given a couple years when another Judge may have given 20 or more for the same crime. Mandatory Sentencing also alleviates the race card.
There is a section written into the Mandatory Sentencing law that after 180 days (6 months), the prison warden automatically writes up a report on the inmate referencing his conduct, recommendations, etc. and it goes back to the court where a lower sentence can be put in place. This is automatic. Everyone from Colorado knew 110 years wasn’t going to be the sentence. The Prosecutor, the day of sentencing already said she would meet with Defense with revised sentencing offer of 20-30 years.
As for time served, this guy has not been locked up for 2 years. At most, he’s been behind jail bars for possibly a month. He wasn’t even required to stay in Colorado and was allowed to go back to Texas. He has been free without even an ankle monitor.
No one in Colorado wants the Governor to get involved. This is a court and the justice system and not political, which families say over and over during the full interview.
I apologize for blasting into you, but this is not a poor man who was treated unfairly, and as long as the Governor keeps his nose out of something where it doesn’t belong, he will be out in no more than 30 years. |
