You're making a false equivalency.
The nature of every executive order is that it can be reversed by the next administration, and Obama knew that. Issuing presidential pardons doesn't even factor into the equation.
Lois Lerner didn't need a pardon because she wasn't charged with anything. A Presidential pardon doesn;t factor into the equation.
Obama has not said or implied, "I know what this person is doing is illegal, but I want them to be able to do it because I need them, so if they are charged with an illegal act, I'll pardon them." Yet that is exactly what Gingrich is suggesting that Trump can do - ignore the conflict of interest laws for his staff and administration by pardoning them if they get caught violating the laws, thereby allowing them to mix personal business with their official duties. That is VERY different from any constitutional overreach you think Obama may have made.
